12-year-old boy cited for hate crime, battery in Modesto

MODESTO, Calif. (AP) - A 12-year-old boy in California has been cited for a hate crime and battery after allegedly attacking his classmate with sticks and using racial slurs while they waited for the school bus.

Eighth-grader NuPhaeya Hassen says the boy approached her Aug. 24, holding the sticks while saying he was a Ku Klux Klan member and raised as a "skinhead." He then hit her with the sticks.

NuPhaeya told The Modesto Bee she responded by slapping the boy, who then threw rocks at her. She says the boy's older sister also assaulted her after school.

A police spokeswoman says the sister will also be cited.

The local NAACP chapter is questioning the Modesto City Schools' handling of the matter. NuPhaeya's grandmother says the girl unfairly received a one-day suspension for defending herself.

Frank Carson murder case layered with many characters

It may be hard to follow each development in the Frank Carson murder case out of Stanislaus County, with so many people involved. So how did Carson, two of his family members, two Turlock liquor store owners and three California Highway Patrol officers get linked in the criminal complaint?

According to investigators from a Stanislaus County Sheriff's Task Force, it all began with Carson being so enraged by metal thefts from a Turlock property. He allegedly recruited brothers Baljit Athwal and Daljit Atwal (different spellings for their last names) to "make an example" of the thieves coming onto his property.

MODESTO - Police continue to search for a gunman who killed one man and hurt seven others early Sunday morning. The shooting happened at a warehouse party on Kansas Avenue near Lone Palm Avenue.

"I heard the gunshots," ear witness Sal Martinez said. "It sounded like two different types of guns. Then yelling and screaming."

Martinez and his young family live less than 100 yards from the warehouse.

"There's always parties back there," he said.
